Section 33(3): a person who takes part in unlawful gaming commits an offence, liable on summary conviction to a fine of not more than 500 penalty units (≈GH¢6,000 at the last-known GH¢12/unit rate) or imprisonment of not more than 2 years, or both. Section 34 separately penalizes gaming/betting in a public place or with an unapproved instrument the same way. Section 35(2): a person found in an unapproved gaming house is presumed to be there to play and is liable to a fine of not more than 250 penalty units (≈GH¢3,000) or up to 12 months, or both. These read on their face as applying to a participant, not only the venue operator — Ghana is a rarer case in this dataset where the player is explicitly, statutorily exposed, not just the operator.

Ghana’s tax authorities gave bettors a real win in 2025. On March 26, Parliament passed the Income Tax (Amendment) Bill, 2025 under a Certificate of Urgency, and a week later — April 2, 2025 — the 10% withholding tax that had been deducted from every betting and lottery payout since December 2023 was gone.[1] The repeal, under Act 1129, applies to winnings only; operators still hand over 20% of Gross Gaming Revenue to the state, a separate tax introduced in 2023 that the 2025 reform left untouched.[2] It’s the opposite trajectory from what we’ve documented in Nigeria and Kenya, where governments have been adding withholding taxes on winnings, not removing them.

Ghana’s crypto story runs in a stranger direction, though. Back in November 2022, the Gaming Commission — the body that licenses every casino and sportsbook allowed to legally operate in the country — told its licensees directly to stop accepting cryptocurrency altogether, flagging it alongside “fictitious means of payments” at an anti-money-laundering training session.[3] That instruction has never been formally reversed. A follow-up Commission workshop in July 2025, held ahead of a 2026 international AML evaluation, again only asked operators to “prepare for future regulations governing cryptocurrency” — not that any exist yet, and not that the 2022 guidance has changed.[4] Separately, Ghana passed a real crypto law in December 2025 — the Virtual Asset Service Providers Act, splitting licensing between the Bank of Ghana and the Securities and Exchange Commission. It legalizes crypto exchanges, wallet providers, and token issuers. It does not mention gambling once.[5]

What that means in practice: none of Ghana’s roughly 28 domestically licensed betting and casino operators can legally take your crypto deposit. If you want to gamble with BTC or USDT as a Ghanaian player, the only route that exists is an offshore casino outside the Gaming Commission’s reach entirely — not because playing offshore is a loophole around Ghanaian law, but because it’s the only way to use crypto for gambling at all.
