Chile bans online gambling by default — a 2005 law reserves games of chance for a short list of licensed exceptions (state lottery, licensed land casinos), and nothing else has ever had a legal path. In September 2025, the Supreme Court confirmed that offshore betting platforms are illegal under that framework and ordered internet providers to block five named domains.[1] On paper, that looks like Chile has settled the question.

In practice, the state is now running two enforcement tracks that don’t agree with each other. Ten months after the block order, Chile’s tax authority (SII) issued Resolución Exenta N°94, naming ten unregistered betting platforms — including Roobet — and building a mechanism to tax them anyway: as of 1 August 2026, Chilean card issuers and bank payment processors must withhold 19% VAT directly on every transaction Chilean users send to those ten platforms.[2] Legal commentators have called this a backdoor legalization — the tax office collecting revenue from activity the country’s highest court just called illegal. Whatever it’s called, the mechanism only reaches what its own text names: debit, credit, and prepaid cards, and banking and non-banking payment operators.[2] A wallet-to-wallet crypto deposit isn’t a card transaction and doesn’t run through a Chilean bank — it sits outside both tracks by construction, not by any loophole someone found.

The licensing bill that could eventually change this doesn’t mention crypto at all. Bill 14838-03 — first introduced in 2022, given the government’s highest legislative priority in May 2026, currently in its second Senate reading with committee amendments due 29 September 2026 — would create a formal licensing body (Superintendencia de Casinos, Apuestas y Juegos de Azar), a 20% tax on gross gaming revenue, and penalties for unlicensed operators.[3][4] Nowhere in its text does it address cryptocurrency as a payment method, permitted or not.[4] That’s still true as of this writing — worth rechecking if you’re reading this after the bill’s committee deadline has passed, since the amendment process could add crypto-specific language either way.

None of this criminalizes the player. Every enforcement action to date — the ISP blocks, the VAT withholding — targets platforms and payment intermediaries, not the person placing a bet. We checked every casino in our database against its own Terms of Service for an explicit Chile or CL restriction: only two, out of more than 40, block it. Eight of the rest — none of them on either the Supreme Court’s block list or the SII’s ten-platform tax list — are covered below.

How we verified: each casino’s Terms of Service was checked directly for a Chile/CL restriction. Chile’s Supreme Court ruling and SII resolution were confirmed against the court’s own reporting and the SII’s official site, not news summaries. Verification was conducted in August 2026.
